JCLI Homeowner Agreement and Contracts

Introduction

The JCLI Homeowner Contracts are for a homeowner / occupier who intends to have work done by a designer and/or landscape contractor to create or improve their garden.  They are produced by SGD for JCLI and comprise of 3 contracts:

  • A consultancy agreement between the customer and consultant for the provision of garden design and associated services like overseeing the contractor’s work or advising the customer while the work is being done (JCLI Homeowner Consultancy Agreement)
  • A landscape contract between the customer and contractor for garden construction and similar works for use when a consultant has been appointed to oversee the contractor’s work for the customer (JCLI Homeowner Landscape Contract with Consultant)
  • A landscape contract between the customer and contractor for garden construction and similar works for use when the customer deals direct with the contractor (JCLI Homeowner Landscape Contract without Consultant)

JCLI Homeowner Documents 2019

The JCLI contracts are available for purchase in hard copy only, in pairs comprising of a Customer’s Copy and a Consultant’s Copy. This can be found in the SGD shop for £17.50 (inclusive VAT).

Homeowner Consultancy Agreement (JCLI HCA 2019)

A Standard Form of Agreement between the Customer (client) and Consultant (garden designer) with Conditions of Contract, for garden design and associated services for a homeowner / occupier.  It includes two options if the consultant is appointed for the garden construction stage, one applicable for each of the two homeowner landscape contracts.

These will be available from the office in hard copy only, in pairs comprising of a Customer’s Copy and a Consultant’s Copy.

 

Homeowner Landscape Contract with Consultant (JCLI HLC/C 2019)

A Standard Form of Agreement between the Customer (client) and Contractor with Conditions of Contract, for garden construction and similar work for a homeowner / occupier, when a consultant has been appointed by the customer to oversee the contractor’s work on their behalf.

These will be available from the office in hard copy only, in pairs comprising of a Customer’s Copy and a Consultant’s Copy.

 

Homeowner Landscape Contract without Consultant (JCLI HLC 2019)

A Standard Form of Agreement between the Customer (client) and Contractor with Conditions of Contract, for garden construction and similar work for a homeowner / occupier, when the customer deals direct with the contractor (with or without the advice of a consultant).

These will be available from the office in hard copy only, in pairs comprising of a Customer’s Copy and a Consultant’s Copy.

Background Information

JCLI Homeowner Documents

The JCLI Homeowner Consultancy Agreement and Landscape Contract with Consultant were first produced in 2011 with JCLI Practice Note No 10 and the Model Forms.  The Homeowner Landscape Contract without Consultant was first published in 2012 with the first revision of the Practice Note, and the Scottish Amendments in 2013 with the second revision of the Practice Note.  The Consultancy Agreement was revised in 2015.

The 2019 revisions of the contracts and associated documents supercede all previous versions and any other documents associated with previous revisions.

JCLI Contracts Forum

The JCLI Contracts Forum agrees and badges commercial and domestic project standard forms of contract and associated guidance documents for the landscape industry. The contracts and guidance are produced and published by individual member organisations.

The JCLI Contracts Forum is organised by the Landscape Institute. Its members are the Association of Professional Landscapers (APL), the British Association of Landscape Industries (BALI), the Horticultural Trades Association (HTA), the Institute of Chartered Foresters (ICF), the Landscape Institute (LI) and the Society of Garden Designers (SGD).

The JCLI badging of contracts is considered important for two main reasons: firstly, because ‘JCLI’ has a strong reputation for contracts, based on the reputation of the Landscape Contract originally produced in 1978; and secondly, because the documents are agreed by the members of the Forum and are therefore non-partisan industry standard documents.

History of JCLI

JCLI was originally the Joint Council for Landscape Industries and was convened in 1973 to bring together all those organisations in any way concerned with landscape design, construction or management. In 2004 it became the Joint Committee for Landscape Industries with a slightly different mission but was dissolved in 2010. The JCLI Contracts Forum was formed in 2010 by the Landscape Institute to continue the existing JCLI contracts and expand the range of contracts. ‘JCLI’ is no longer an acronym.

JCLI documents were always produced by individual member organisations but agreed by JCLI and badged JCLI. This continues with the JCLI Contracts Forum, which is only concerned with contracts and associated documents for the landscape industry.
